Conditions of Entry for the ‘BookRix-Writing Competition'
The participation in the English BookRix-Competition (hereinafter: "Competition") arranged by BookRix GmbH & Co. KG ("Provider") are subject to and governed by the conditions of entry hereinafter "Conditions and Rules") set out below:
1. Approval to Conditions and Rules by the User The User approves and consents to the Conditions and Rules by participating in the Competition. It is possible to participate in the Competition as an author and/or as a reviewer. This consent to the Conditions and Rules is given regardless whether a User participates in the Competition as author or as reviewer.
2. Applicability of GTC and the privacy policy In general, the Competition is subject to and governed by the General Terms and Conditions (GTC) and the privacy policy of BookRix GmbH & Co. KG (Provider) unless these Conditions and Rules provide for deviant or special rules.
3. Possible entrants Any User can participate in the Competition. The participation of minors is subject to prior consent of their legal representative(s). Personnel of the Provider or of BookRix Verwaltungs-GmbH and their respective relatives (§ 15 of the German revenue code [Abgabenordnung - AO]) must not participate in the Competition.
4. Payment There is no fee to participate in the Competition.
5. Participation as author (author-evaluation) An author has to register on Bookrix.com and upload his or her self-created book to the site in order to register for the Competition. An author can register more than one book for the Competition.
6. Requirements for books (rights of the author, volume and language) Only self-created books may be registered for the Competition. This means that the author must own all the rights to the registered book and the contents of the book. Books which violate the rights of Third Parties must not be registered. Moreover, books which are registered for the Competition must not contain more than 25 BookRix pages (based on the BookRix format) and must be written in English.
Books that were registered in the first BookRix competition, the “Web Your Book Award”, can not be registered for the Second BookRix competition.
7. Participation as reviewer (reviewer-drawing) In addition, every User can participate in the Competition as a book reviewer. Participation as reviewer requires placing a star in favour of a book which has been registered for the Competition. Users who participate in the Competition as reviewers automatically participate in the drawing. It is possible to vote for more than one book. However, this does not increase the chances in the drawing.
8. Notes with respect to chances to win in the drawing and to the number of valuations The chances of a User who participates in the Competition as reviewer are not increased if the User votes for more than one book registered for the Competition. In case a User votes more than once for a particular book, his or her votes count as just one vote.
9. Recommendation with respect to valuation-criteria The Provider recommends taking into account the following criteria when rating books: creativity, design, form and style. However, these criteria are neither exhaustive nor binding. Users are free to choose to vote on books based on their own criteria.
10. Registration; deadlines for the registration of books and filing of valuations Users can register books with the Provider for the Competition between June 24, 2009 to July 24, 2009, 12 p.m. EDT/9 p.m. PDT only. Books that are registered after such date and time will not be taken into account. Users can only vote on books that were registered for the Competition between June 24, 2009 and July 24, 2009, 12 p.m. EDT/9 p.m. PDT. Votes can only be filed online on BookRix.
11. Prizes for authors For the author contest, a First, Second and Third place winner will be determined based on the amount of votes cast per book. The first place prize will be won by the User (author) of the book that won the most votes. The second place winner will be the User (author) of the book that obtained the second highest amount of votes. The third place will be won by the User (author) of the book that obtained the third highest amount of votes. In case the same number of votes is filed in favor of more than one book, there will be a drawing to determine the winner of the prize. Users participating in the author contest in the Competition can only win one prize (place) in the author contest. In case a User registers more than one book for the Competition and more than one book from this User (author) obtains the number of votes required to be among the first five places, this User (author) will only win the prize (place) determined by the book with the largest (highest) number of votes. The author will not win any more prizes (places) from his or her other books. The Users (authors) with the next highest amount of votes for their registered books move up in the rankings.
12. Prizes for the reviewer-drawing Three winners will be determined among the Users participating in the Competition as reviewers. The Users that have participated in the Competition as reviewers (who have filed at least one vote) will be entered into a drawing to determine the winners.
13. Notification and publication of the names of the winners The Provider will notify all winners on or before July 31, 2009, via e-mail. In addition, the names of the winners will be published on BookRix as well as in the Provider's newsletter.
14. Publication of books of winners; transfer of rights to Provider The Provider is entitled to publish the registered books that have won the three highest places in the author contest for reports covering this Competition as well as for the purpose of advertising and promoting BookRix. The publication is effected by presentation of the respective book as an electronic file which can be downloaded and saved by anybody within and/or in the context with reports covering the Competition and/or for the purposes of advertising and/or promotion of BookRix on BookRix, within the newsletter of the Provider and/or on other data carriers. The Provider obtains this right to publish free of charge and without the respective Users (winners) having any claim to consideration or compensation. Every User who participates in the Competition as author hereby expressly approves and consents to publication of his or her registered book within and in the context of reports covering the Competition as well as for the purposes of advertising and promoting BookRix in case the respective User wins one of the three prizes within the author-evaluation. For this case every User participating in the Competition as an author hereby expressly states and represents that the Provider does not owe the User any consideration, payment, compensation, transfer of profit or forbearance as a result of or in connection with the publication of his or her book. This means that every User which participates in the Competition as an author hereby grants to the Provider, free of charge, the right to publish the respective book as an electronic file which can be downloaded and saved by anybody within and/or in the context with reports covering this Competition and/or for the purposes of advertising and/or promotion of BookRix on BookRix, within the newsletter of the Provider and/or on other data carriers in case the User wins one of the three prices within the author-evaluation.
15. Prices for winners in the author contest The winners in the author-evaluation will obtain the prices set out below: First place: ($1000) Second place: ($500) Third place: ($300)
16. Prices in the reviewer drawing There will be a drawing for three $100 prizes. This means that each of the three winners drawn will win $100.
17. Payment of monetary prices; non-assignability of claims to prices The Provider will pay the monetary prices to the respective winners by remitting the respective amounts to the bank accounts notified to the Provider by the respective winners. Winners must not assign their claims to prizes from the Provider to other persons.
18. Notification of winners; re-notification deadline for winners; preclusion of claim to prize The Provider will notify winners via e-mail. Following notification, winners must notify the bank account to which the monetary prize is to be and the mailing address to which the non-monetary prize is to be sent within one month as of receipt of the notification that the prize has been won. Such re-notification must be made to the Provider in written form or via e-mail. In case the data/information required are not notified to the Provider within one month, the respective winner will lose their claim to the price.
19. Use of bank account for remittance of the monetary prizes only In case winners of the Competition send their bank account related information/data to the Provider, the Provider will use such information/data to remit the monetary prize only. The Provider will not pass on such bank account related information/data to Third Parties.
20. Exclusion of Users from the Competition by the Provider; consequences of exclusion The Provider is entitled to exclude Users which violate the GTC of the Provider, these Conditions and Rules and/or the Code of Conduct from the Competition. Users who are excluded from the Competition automatically cease to participate in the Competition.
22. Special note with respect to the limitation of liability of the Provider and certain prohibitions Again, reference is made to sections 9, 10, 18, 19, 20 and 22 of the GTC.
23. Exclusion of legal process Any recourse to the courts and legal steps are excluded.
