This declaration on the Provider's Privacy Policy is intended to inform Users on how and to which extent the BookRix GmbH & Co. KG ("Provider") collects, saves, processes and uses Personal Data, to what extent third parties are granted access to the Personal Data of Users and/or to what extent the Provider discloses and/or passes on Personal Data to third parties.
Please note that in addition to this Privacy Policy the General Terms and Conditions ("GTC") of the Provider also apply to the service.
Certain Definitions:
The Provider uses certain definitions in this Privacy Policy that should be known by Users:
- "Provider" is the BookRix GmbH & Co. KG, Munich, registered in the commercial register at the local court (Amtsgericht) of Munich under HR A no. 92039 (further information concerning the Provider can be found under about us).
- "Personal Data" are all informations regarding the personal, business like or other circumstances of Users.

"BookRix-Websites" are the Websites on which the Provider offers its services including certain sub-domains and aliases.

"User" is every person that makes use of and/or takes access the BookRix-Websites.

"Registered Users" is any person, company, partnership, cooperation, corporation, trust or other legal entity which has completed and sent the electronic registration form on BookRix.

"Required Data" are the mandatory Personal Data that Users must provide for in order to register at BookRix.

"Profile" is the compilation of Personal Data that Users assign to be disclosed to other Users alongside their Username and language to make up for their personal representation.

"Associated Companies" are persons, companies, partnerships, cooperations, trusts or other legal entities that convey advertisements, information or other data to Users on the BookRix-Websites on grounds of a contractual relationship with the Provider.
Provider Collects, Saves, Processes and Uses Personal Data
The Provider collects, saves, processes and uses Personal Data of Registered Users and other Users in compliance with the laws of the Federal Republic of Germany, particularly in compliance with the German Code of Data-Protection (Bundesdatenschutzgesetz), the German Code of Telecommunications Media (Telekommunikationsgesetz) and the German Code of Telemedia (Telemediengesetz) as well as the regulations of the European Union on the protection of data.
User's Approval and Right of Withdrawal
Users approve that their Personal Data are collected, saved, processed and used by the Provider to the extent that is defined by this Privacy Policy. Users have a right to withdraw their approval at any time with immediate effect for the future. The withdrawal of the approval by Users has to be communicated to the Provider in writing or by e-mail [contact-en@bookrix.com].
Collection of Personal Data for the Purpose of Registration
The Provider collects the following Personal Data of Users for the purpose of registration: personal password, e-mail-address, Christian name, surname, address, date of birth and language. The declarations of those Personal Data are obligatory for the registration. In addition Users have to give themselves a User-name on registration. In addition to that, Users may complete their profile with certain optional and voluntary Personal Data, e.g. gender, place of origin, profession, messenger-data (ICQ, Skype, etc.), URL of their personal website, self-characterization, favourite literature, favourite citation and the last book they read.
Collection of Personal Data during the Use of the Service
In addition to the above mentioned collection of Personal Data the Provider will collect further data of Users under an alias, e.g. the track record of Users, their utilization of BookRix and/or its different functions. Such additional data of Registered Users are recorded and used for statistical purposes as well as purposes of upgrading, amending or improving the service. Users can withdraw their approval with such tracking of their Personal Data under an alias with immediate effect for the future at any time. The withdrawal has to be declared to the Provider by writing or by e-mail [contact-en@bookrix.com].
Visibility of Personal Data for Other Users
The User-name and the User language of Registered Users are always visible for other Users. In addition to that the place of origin and the country of origin of Registered Users are visible on the community-site. If Users decide to complement their profile with certain further data and/or a picture, such data will be disclosed to and visible for other Users to the extent the User has allowed the data to be disclosed.
Personal Data in or as Part of User-Content
The Provider is not responsible for the passing on or the publishing of Personal Data that have been placed on BookRix by Registered Users in or as part of (User generated) content. The Provider is also not responsible for the disclosure or the passing on of Personal Data that is contained in or is part of content or links of Registered Users to other homepages of the World Wide Web. Users are themselves responsible for their contents or the contents of other Users or third parties that have been passed on or published by the Users on the BookRix-Websites. In this respect we explicitly refer to our GTC.
Usage of E-Mail-Addresses of Registered Users
Users have to file their e-mail-addresses in the process of registration.
The Provider uses the e-mail-addresses in order to provide a newsletter for Users upon request or to inform Users on other important issues on or about BookRix. The newsletter is only provided for upon request and can be unsubscribed at any time. The Newsletter will not be sent to Users that have unsubscribed the newsletter.
In addition to that the e-mail-address of Registered Users will be used to make contact to these Users in case that any content or other data of the Users or the behaviour or attitude of the User on the BookRix-website prompt the Provider to contact the User, e.g. in case the Registered User interferes with or encroaches the rights of other Users or third parties or in case the User behaves inadequately or unreasonable.
Above that other Users can use the e-mail-address to contact the User if the User has disclosed his/her e-mail-address to other Users on the BookRix-Websites.
Use of Personal Data for the Operation of BookRix
The Provider uses Personal Data mainly to enable Registered Users and other Users to make use of the BookRix-Websites.
Usage of Personal Data in Order to Protect Laws and the Rights of other Users and Third Parties
The Provider also uses Personal Data in order to make sure that all Users obey the laws and rights of other Users and third parties while using BookRix and in order to make sure that any unlawful or illegal behaviour by Registered Users or other Users can be adequately prosecuted. The Provider is not obliged to control or scan Content for any illegal or unlawful data content.
Usage of Personal Data for the Purpose of Advertising or the Information of Users
The Provider also uses Personal Data of Registered and other Users in order to implement and convey selective advertisements or other informations of associated companies to Registered and other Users insofar as such Personal Data give rise to the assumption that the User may have a certain interest in the advertisement or information ("Targeting"). Personal Data will in no case be passed on to associated companies.
Transfer of Personal Data on the Grounds of Laws, Rulings, Administrative Decisions or Claims or Rights of Third Parties
The Provider is entitled to disclose and/or pass on Users Personal Data to authorities, courts and other public authorities in case the Provider is obliged to such an action by laws, acts, rulings or administrative decisions by courts or other public authorities. The provider is not obliged to challenge or appeal against such laws, acts, rulings or other decisions of courts or other public authorities. Rather, the provider is entitled to offhand comply with such laws, acts, rulings or other decisions of courts or other public authorities. In addition the provider is entitled to disclose or pass on Personal Data of a User insofar as and to the extent to such a third party can legally claim disclosure and/or transfer of Personal Data from the provider.
Deployment of Cookies
The BookRix-Websites deploy cookies when a User takes access to the BookRix-Websites. The cookies contain certain Personal Data of the User, e.g. User name, books that have been read by the User and the page of the book where the User has interrupted his last readings. Cookies will be saved on the computer of the User.
Users Claim for Disclosure Regarding Personal Data
Users have a claim for disclosure against the provider regarding their Personal Data to the extent legally granted by the applicable laws. Users who want to make use of their claim for disclosure may approach the provider at any time by e-mail [contact-en@bookrix.com].
